TERMS & CONDITIONS

By accessing or using the website www.ERCreativeCo.com and/or purchasing services from ER Creative Co. ("we", "our", or "us"), you agree to comply with and be bound by the following Terms and Conditions ("Agreement"). Please read these terms carefully before making a purchase.
PAYMENTS & REFUNDS
All payments will be made via official invoice. We accept all major credit and debit cards. For larger projects, a deposit is required to secure your spot with the remaining balance due before final delivery of project files. For smaller services, full payment is required upfront. We do offer flexible payment options such as Klarna, and Afterpay at checkout.
Due to the nature of the services offered, ER Creative Co. does not issue refunds under any circumstances. All sales are final. If you, the client, are unsatisfied with the services provided, we are committed to working with you to find a satisfactory resolution. Refunds will only be issued at designers discretion.
CANCELLATIONS
All payments are non-refundable. If you [client] decide to cancel at your own discretion you will forfeit your project and will not be refunded. Refunds will only be issued at designers discretion. By purchasing any service you [client] are agreeing to our no refund policy.
If you choose to cancel your project, any amount paid whether in full or as a deposit cannot be returned. Please ensure you are ready to move forward before booking. ER Creative Co. reserves the right to discontinue or refund a project at our discretion if a client engages in behavior that is abusive, disrespectful, or makes the project unreasonably difficult to complete. This includes, but is not limited to, hostile communication, combative behavior, or failure to provide necessary information or approvals in a timely manner. ER Creative Co retains ownership of all copyrights and original work created prior to cancellation.
TURNAROUND TIMES
Brand Identity and Single Services: 10–14 business days.
Website Development: 3–4 weeks. Rush orders are not available for website development. Timely submission of all required information is necessary to meet the expected turnaround time.
Branding Packages: The turnaround time for branding packages varies based on the selected package, with an average of 2–3 weeks. Rush order options are not available.
Turnaround times may vary due to unforeseen circumstances, such as natural disasters, family emergencies, or illness. If any such event occurs, the client will be promptly notified.
DELIVERABLES
Once the services are approved by the client, final deliverables will be exported as PNG, PDF, and JPEG via a Dropbox link sent to the client's email. If the client requires other formats (such as SVG, AI, or PSD), a request must be submitted.
REVISIONS
All services (excluding website development) include 3 revisions. These revisions may include changes to brand colors, typography, alignment, or sizing. After the third revision, the project will be considered finalized. Any additional revisions will incur a fee of $25 per revision. ER Creative Co. retains all rights to the service proofs and these should not be used in any format until the project is finalized and fully approved.
BOOK WITH A VISION
It is essential that the client has a clear vision for their brand before booking services. We encourage clients to be thorough when providing details, including brand values, backstory, brand palette (with hex codes), and any specific design preferences.
Please refrain from vague requests such as:
"Make it pop!"
"I'm not creative, you can freestyle."
"Just create what you think looks best."
COMMUNICATION AND GHOSTING
Consistent communication is key to a successful design process. Clients are encouraged to maintain communication with ER Creative Co. throughout the project. If you [client] fails to respond to emails or messages for 7 business days, the project will be paused. To reinstate the project, a $50 fee will be charged.
If the client does not provide requested information or respond within 30 business days of booking, the project will be archived, and a $100 reinstatement fee will be charged to resume the design process. This lack of communication is referred to as "ghosting," which is not encouraged.
CONFIDENTIALITY
We respect your privacy and confidentiality. Any personal or business information you provide will be kept confidential and will not be disclosed to third parties except as required by law.
GOVERNING LAW
ER Creative Co. reserves the right to modify these Terms and Conditions at any time, and the updated version will be posted on the website. These terms are governed by the laws of Louisiana, and any disputes will be subject to the jurisdiction of courts in Louisiana.
INTELLECTUAL PROPERTY RIGHTS
Upon full payment, the Client will own the final deliverables. However, the Designer retains the right to use the work in portfolios, case studies, and marketing materials unless otherwise agreed in writing.
By purchasing services from ER Creative Co. through our website, you acknowledge and agree that you have read, understood, and accepted these Terms and Conditions. Your purchase constitutes a binding agreement between you and ER Creative Co. and you are bound by these terms.
